Subscriber Agreement
Welcome to MOWii Plus / MOWii+™. It is our pleasure to provide the streaming, digital media, entertainment, and related services described below for your personal enjoyment in accordance with this Subscriber Agreement (“Agreement”). PLEASE READ THIS AGREEMENT CAREFULLY BECAUSE IT GOVERNS YOUR ELIGIBILITY FOR AND USE OF THE SERVICES.
For detailed information on how to cancel your subscription, see Section 2(e) below.
This Agreement is entered into between you and MOWii Media, doing business as MOWii Plus / MOWii+™ (“MOWii”, “we”, “us”, or “our”). The “MOWii Plus Service” includes the MOWii+™ website, applications, media players, streaming platforms, related software, associated content, community features, live events, and all related services and features, in any media format or distribution channel now known or later developed (collectively, the “Services”).
By clicking “Agree & Continue,” creating an account, purchasing a subscription, or otherwise accessing or using any part of the Services, you agree to this Agreement and any policies incorporated herein by reference. If you do not agree to this Agreement, you may not access or use the Services.
We may modify this Agreement from time to time. Changes will become effective thirty (30) days after posting or notifying you unless otherwise required by law. Continued use of the Services after changes become effective constitutes acceptance of the revised Agreement.
ANY DISPUTE BETWEEN YOU AND MOWii MEDIA, EXCEPT FOR SMALL CLAIMS MATTERS, SHALL BE RESOLVED THROUGH INDIVIDUAL BINDING ARBITRATION AND NOT IN COURT. PLEASE REVIEW SECTION 7 CAREFULLY, AS IT AFFECTS YOUR LEGAL RIGHTS.

1. USER ELIGIBILITY AND REGISTRATION
a. Eligibility and Age Limitations
You must be at least eighteen (18) years old, or the age of majority in your jurisdiction, to purchase a subscription to the Services. The Services are intended solely for personal, non-commercial use.
b. Territory
The Services are offered only in locations where MOWii Media has rights to distribute content. Access may be restricted in certain countries, states, or regions.
c. Registration and Account Security
To access certain portions of the Services, you must create an account and provide accurate, current, and complete registration information, including a valid email address and payment method where applicable.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You agree to notify us immediately of any unauthorized use of your account.
d. Notices and Electronic Communications
You consent to receive notices and communications electronically, including via email, push notification, or posting within the Services. Such communications satisfy any legal requirement that communications be in writing.
2. SUBSCRIPTION TERMS
a. Service Plans and Features
We may offer different subscription plans, service tiers, promotional bundles, premium access levels, ad-supported plans, live event access, or add-on services. Features and pricing may vary by plan.
b. Billing and Automatic Renewal
Subscriptions are billed on a recurring basis according to the billing cycle selected during purchase (monthly, annual, or otherwise disclosed).
Unless cancelled before renewal, your subscription will automatically renew, and you authorize us to charge your payment method for recurring subscription fees, taxes, and applicable charges.
We reserve the right to change subscription pricing upon reasonable prior notice.
c. Free Trials and Promotions
We may offer free trials, discounts, promotional codes, or limited-time offers at our discretion. Unless cancelled before the promotional period ends, billing will automatically begin using your designated payment method.

d. Gift Cards and Promotional Credits
MOWii Media may issue gift cards, account credits, referral rewards, or promotional credits subject to separate terms and expiration conditions.
e. CANCELLATION AND REFUND POLICY
YOU MAY CANCEL YOUR SUBSCRIPTION AT ANY TIME BEFORE THE NEXT BILLING DATE.
Cancellation will become effective at the end of the current billing period unless otherwise stated. Except where required by applicable law, subscription fees are non-refundable and we do not provide refunds or credits for partially used billing periods.
If you subscribed through a third-party platform such as the Apple App Store, Google Play, Roku, Amazon, or another provider, you must manage cancellations through that provider.
To cancel directly through MOWii+, log into your account settings and follow the cancellation instructions provided.
f. Payment Information
You authorize MOWii Media and its payment processors to store and process your payment information for recurring billing purposes. You agree to maintain accurate and current payment information.
If payment fails, we may retry billing, suspend access, or terminate your subscription.
g. Third-Party Billing
Subscriptions purchased through third-party providers remain subject to the billing and cancellation policies of those providers.
h. Advertising and Sponsored Content
Certain subscription plans may include advertisements, sponsorships, branded integrations, or promotional content.
3. INTELLECTUAL PROPERTY LICENSE AND RESTRICTIONS
a. Limited License
Subject to this Agreement, MOWii Media grants you a limited, non-exclusive, revocable, non-transferable license to access and use the Services for personal, non-commercial purposes only.
All content made available through the Services, including videos, films, interviews, podcasts, livestreams, graphics, music, branding, logos, software, artwork, text, and other materials (“Content”), remains the property of MOWii Media and/or its licensors.
b. Restrictions
You may not:
Copy, reproduce, redistribute, or publicly display Content without permission;
Reverse engineer or interfere with the Services;
Remove copyright or trademark notices;
Circumvent security or DRM technologies;
Use automated systems such as bots, scrapers, or AI data extraction tools;
Train artificial intelligence or machine learning systems using the Services or Content;
Use the Services for unlawful or commercial purposes without authorization;
Share your login credentials outside your household where prohibited.
Violation of these restrictions may result in suspension, termination, and legal action.
4. USAGE TERMS
a. Compatible Devices
The Services may only function on supported devices, browsers, applications, and internet connections.
b. Internet Access
You are responsible for obtaining and maintaining internet access and all associated charges.
c. Streaming and Downloads
Certain content may be available for streaming or temporary offline viewing depending on your subscription plan and device compatibility.
d. Content Availability
Content availability may change without notice due to licensing, legal, technical, or operational reasons.
e. Live Events and Broadcasts
Live programming, events, interviews, and streams may experience interruptions, delays, blackouts, or cancellations beyond our control.
f. Experimental Features
We may test new features, layouts, pricing structures, or technologies from time to time without notice.
5. PRIVACY AND INFORMATION USE
Your use of the Services is also governed by the MOWii Media Privacy Policy.
By using the Services, you consent to our collection, use, storage, and sharing of information as described in the Privacy Policy and applicable law.
We may disclose information where required by law, court order, subpoena, legal process, or to protect the rights, safety, or security of MOWii Media, our users, or others.
6. SUSPENSION AND TERMINATION
We reserve the right, in our sole discretion and without liability, to suspend, restrict, or terminate your access to the Services if:
You violate this Agreement;
Fraudulent or suspicious activity is detected;
Required by law or governmental request;
Technical or operational issues arise;
Your payment method fails repeatedly.
Upon termination, your right to access the Services and Content immediately ceases.
7. BINDING ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY.
a. Agreement to Arbitrate
You and MOWii Media agree that any dispute, claim, or controversy arising out of or relating to the Services or this Agreement shall be resolved exclusively through final and binding individual arbitration, except for disputes eligible for small claims court.
b. Class Action Waiver
YOU AND MOWii MEDIA AGREE THAT ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
c. Governing Arbitration Rules
Arbitration shall be administered by a mutually agreed arbitration provider in accordance with applicable arbitration rules and the Federal Arbitration Act.
d. Venue and Governing Location
Any arbitration hearing or legal proceeding permitted under this Agreement shall take place in Los Angeles County, California, unless otherwise required by applicable law.
You consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California for purposes of enforcing arbitration awards or obtaining injunctive relief.
e. Opt-Out
You may opt out of this arbitration agreement by sending written notice within thirty (30) days of first accepting this Agreement.

8. ADDITIONAL PROVISIONS
a. Entertainment Purposes Only
Content provided through the Services is for entertainment and informational purposes only and does not constitute legal, medical, financial, or professional advice.
b. Third-Party Services
The Services may integrate with third-party platforms, payment processors, devices, or applications. MOWii Media is not responsible for third-party services or policies.
c. Mobile Networks
Carrier charges, data fees, and roaming charges may apply when using mobile devices.
d. Export Controls
You agree to comply with all applicable export and trade laws relating to the Services.
e. Submissions and User Content
If you submit comments, ideas, feedback, media, or other materials to MOWii Media, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, display, modify, and promote such materials.
f. DISCLAIMERS OF WARRANTIES
THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOWii MEDIA DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY.
g. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOWii MEDIA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED ONE THOUSAND U.S. DOLLARS (US $1,000).
h. Choice of Law
This Agreement shall be governed by and construed under the laws of the State of California and applicable United States federal law, without regard to conflict of law principles.
i. Choice of Forum
Except where arbitration applies, any legal action relating to this Agreement shall be brought exclusively in the state or federal courts located in Los Angeles County, California.
j. Severability
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
k. Survival
Sections relating to intellectual property, arbitration, liability limitations, indemnification, and other provisions intended to survive termination shall survive termination of this Agreement.
l. Entire Agreement
This Agreement, together with incorporated policies and disclosures, constitutes the complete agreement between you and MOWii Media regarding the Services and supersedes all prior agreements or understandings.
